It is one of the hottest topics in our political discourse. It is one of the more complex legal issues, pitting the power of the Federal government against States’ rights. Of course, the issue is the legalization of marijuana. Florida’s Medical Marijuana Law
As a threshold matter, medical marijuana is available in Florida, however it is still considered illegal under Federal law. With regard to Florida law on medical marijuana, which is administered by the Florida Department of Health Office of Medical Marijuana Use, patients must have a qualifying medical condition to be eligible to obtain marijuana for medicinal use. Those qualifying ailments include multiple sclerosis, Crohn’s disease, HIV/AIDS, post-traumatic stress disorder, Parkinson’s disease, and “other debilitating medical conditions of the same kind or class.”
Florida law oversees the training of physicians before they can prescribe medical marijuana. Patients must be approved for marijuana use, and then need to apply for a medical marijuana card upon approval. Unfortunately, obtaining the card could take months. The law allows patients to receive a 70-day supply of medical marijuana at one time. If, after 30 weeks, patients wish to continue use, they must again see a physician in person. Finally, insurance cannot cover any part of the process with regard to medical marijuana.
